[Webinar Review] Interpretation and Practice of Japan Export Control

Overview 

On December 13, Ficient Global held the Webinar “Interpretation and Practice of Japan Export Control”. We invited the principal of Global Trade Security Consulting Pte Ltd, George Tan. George started to involve in export control since 1985. He specializes in international trade compliance with practical experience on export control compliance. He is familiar with Asian export control regimes and is an advisor to multinational corporations, small & medium enterprises and sovereign clients on strategic goods controls, with a particular focus on compliance and enforcement. 

George updated Japan’s Control List and talked about technology transfer control, Japan sanctions and the impact on Chinese enterprises, etc. 


Contents 

1. Control List Update 

On 6th December 2022, Japan updated its control list, including 15 items revised in total. In order to strengthen Export Control for Advanced Semiconductor Manufacturing Equipment, 23 items were added on 23rd July 2023. 


2. Technology Transfer Control 

Previously, there were no regulations on technology transfer between residents in Japan. Technology transfer only limiting to transfer from resident to non-resident. From May 2022 onwards, if a resident who receives technology transfer is “significantly affected by non-resident”. Technology transfer from resident to that resident is regarded as technology transfer from resident to non-resident and it will be controlled. 


3. Outreach to SMEs 

Japan published new guidance and information meetings to raise awareness of export control. Upon request, the Japanese government dispatches exports to SMEs and Japan Chamber of Commerce and Industry (JCCI) provides consultation service with the support of the expert dispatched from the government. 


4. Sanctions (Russia and Belarus) 

Ever since the Russia Ukraine war, Japan has put on strong sanctions against Russia. George Tan listed the dates and measures of Japan sanctions. 


5. Impacts on Chinese Enterprises 

In general, the impacts on Chinese enterprises include the following: 

- US DPL & “sanctions” 

- METI’s Foreign User List (FUL) on November 2022 

- Chinese enterprises in Japan may not receive necessary support 

- Private company generally still willing to support Chinese enterprises and continue to do business
