[Webinar Review] Latest Development on Export Control on Singapore, Thailand, Malaysia and Philippines in 2022

On Feb.28, 2023, Ficient Global held the Webinar “Latest Development on Export Control on Singapore, Thailand, Malaysia and Philippines in 2022”. We invited the principal of Global Trade Security Consulting Pte Ltd, George Tan. George started to involve in export control since 1985. He specializes in international trade compliance with practical experience on export control compliance. He is familiar with Asian export control regimes and is an advisor to multinational corporations, small & medium enterprises and sovereign clients on strategic goods controls, with a particular focus on compliance and enforcement. 

George first focused on the four countries (Singapore, Thailand, Malaysia and Philippines) within ASEAN, where they have already established the export control system. He also briefly updated what was happening around the rest of the ASEAN countries.

1. Singapore

First of all, George introduced the export control system in Singapore.

 

Singapore started export control in 2003. The strategic goods list started with 600 items by broad categories. In 2008, Singapore fully adopted EU Dual-use List and WA Munitions List.

 

Singapore have 3-Tiers Licensing Scheme: Individualx1, Bulkx2. Under the Trade Facilitation Scheme, initially Singapore introduced the Approved Company Scheme 2003(“ACS”) and in 2011, it changed to Strategic Trade Scheme(“STS”).

 

George also introduced the basic structure of The Strategic Goods (Control) Act (Chapter 300)“SGCA”, the control lists, the transshipment control, the transit control and the brokering control. George also mentioned the Trade Facilitation & Integrated Risk-based System (TradeFIRST) , the Voluntary Disclosure Program (VDP) and Singapore’s export controls measure to Russia.

 

2. Malaysia

Next, George updated Malaysia’s export control system.

 

2021 marked the 10th anniversary of STA 2010 implementation in Malaysia (i.e., from 2011 to 2021), critical to which has been the establishment of the Strategic Trade Secretariat (‘STS’) to administer and manage the STA. Malaysia is one of the most active STM regimes in the region, and has, over the last decade, organized significant industry outreach to foster good relationship with industry. In 2017, following industry feedback and comment since 2013, a number of revisions were made to the STA.

 

George also mentioned the ICP elements of Malaysia.

 

3. Philippines

Then George introduced Philippine’s Strategic Trade Management Act (STMA) Implementation Basecamps. By the end of 2022, the STMO target is to have to regulated all items covered under Annex 2 of the National Strategic Goods List (‘NSGL’) and those covered by the catch-all provisions under Section 11 of the STMA. By 2025, the STMO will expand its regulation to include financing, transit, transshipment, reexport, and reassignment. Finally, by 2028, it will cover imports of strategic goods and the provision of related services.

 

National Strategic Goods List of Philippines includes Annex I - Military List, Annex II - Dual-use List and Annex III -Nationally Controlled Goods List.

 

George also discussed the STMA implementation preparation, the structure framework, and company obligation and facilitation, etc.

 

4. Thailand

After that, George explored Thailand’s Trade Control on Weapon of Destruction ACT, B.E. 2562 (2019) “TCWMD ACT”. He talked about the highlights, controlled activities and authority of officer of Catch-All Control (“CAC”), as well as the ICP requirement. ICP Application can be submitted online via DFT Website: tcwmd.dft.go.th. DFT will announce a window of time when they will start accepting ICP application on its website.

 

At last, George touched the export control management in Indonesia, Vietnam, Laos, Cambodia, Brunei, Myanmar and gave an overview of Asia STM Regimes.
